ECtHR Ordered Russia to Drop Death Penalty against Two British Prisoners

Thursday, 30 June 2022

The Human rights court ordered Russia not to allow the execution of British convicts in occupied Donetsk.

The ECtHR urges the Russian government not to carry out the death penalty against two British citizens, servicemen of the Armed Forces of Ukraine. They were surrendered by Russian troops during hostilities and sentenced to death in the so-called Donetsk People's Republic.

"Under Rule 39 of the Rules of Court, the Court may indicate interim measures to any State Party to the European Convention on Human Rights. Measures under Rule 39 of the Rules of Court are decided in connection with proceedings before the Court, without prejudging any subsequent decisions on the admissibility or merits of the case. The Court grants such requests only on an exceptional basis when the applicants would otherwise face a real risk of irreversible harm," says the official ECtHR statement from June 30.

The Court also ordered the Ukrainian government to ensure, in so far as it was possible to do so, respect for the Convention rights of Shaun Pinner and Aiden Aslin and invited them to submit any information which they consider relevant within the same period of two weeks.

Two British prisoners, Shaun Pinner (48 y.o.) and Aiden Aslin (28 y.o.) face the death penalty in the so-called Donetsk People's Republic, which is controlled by pro-Russian authorities. They were accused of being mercenaries and taking actions aimed at seizing power and overthrowing the so-called constitutional order of the unrecognized pseudo-republic of the DPR.

Moroccan Brahim Saadoune was also given a death sentence by the Russians on the same grounds, and the ECHR issued a similar ruling earlier this month.

The United Kingdom, the United States, Ukraine, and other states and organizations have condemned the verdict.

Foreign Secretary Liz Truss said the British government was "working hard" to secure the release of two Britons sentenced to death.
